Speak & Play Terms of Service

This Terms of Service agreement (the “Terms”) is a binding agreement between you ("End User" or "you") and Autism Inventory, Inc. (“Speak & Play”). These Terms govern your use of the Speak & Play website and platform (the “Site”) and the related artificial intelligence–powered services, tools, and reports offered through the Site (together with the Site, the “Services”).
The Services are licensed, not sold to you, subject to your acceptance of the terms, conditions, and notices contained herein.
By clicking to accept, using the Site, or otherwise using the Services, you:
(A) acknowledge that you have read and understood these Terms;
(B) represent that you are of legal age to enter into a binding agreement; and
(C) accept these Terms and agree that you are legally bound by them and the Speak & Play Privacy Policy.
If you do not agree to these Terms, you must not use the Site or the Services. These Terms include an arbitration provision and class action waiver. By agreeing, you waive the right to trial by judge or jury and the right to participate in class or representative actions.
1. License Grant
Speak & Play grants you a limited, non-exclusive, non-transferable license to use the Site and Services for personal use on devices you own or control, subject to these Terms.
2. Changes to the Terms
We may update these Terms from time to time. Any material changes will be communicated through the Site or via user notifications. The “Last Updated” date at the top of these Terms reflects the current version. Continued use of the Services after changes constitutes acceptance.
3.Your Account
You may need to create an account to access some Services. You must provide accurate, current information and keep it updated. You are responsible for safeguarding your password and for all activity on your account. Speak & Play may disable or terminate accounts at its discretion if terms are violated.
4. Intellectual Property and Acceptable Use
Access: Account access is limited to the registered user. You may not sell, rent, or transfer access without written permission.
Protection: You are responsible for maintaining the security of your account.
Acceptable Use: You may not copy, modify, reverse engineer, or misuse the Services. Prohibited actions include harassment, unauthorized commercial use, impersonation, or uploading harmful or infringing content. Speak & Play reserves the right to remove content or suspend accounts at its discretion.
5. User Content
You own all input you provide to the Services (“Input”). Speak & Play assigns you rights to the output generated (“Output”), subject to compliance with these Terms. However, due to the nature of AI, similar outputs may appear for multiple users. Speak & Play may use Content to maintain and improve Services, enforce policies, and comply with laws.
6. Ownership, Trademarks, and Privacy
Ownership: All Site content, trademarks, and branding belong to Speak & Play. Unauthorized use is prohibited.
Privacy: Personal information is collected and used under the Speak & Play Privacy Policy.
7. Indemnification
You agree to indemnify and hold harmless Speak & Play, its affiliates, and employees against claims arising from your use of the Services or violation of these Terms.
8. Disclaimers
8A. No Medical Advice, Diagnosis, or FDA Approval
The Services are provided for informational and educational purposes only. Speak & Play reports, activities, and insights are not medical advice, therapy, or diagnosis, and must not be relied upon as such.
Speak & Play is not an FDA-approved or cleared medical device.
Speak & Play does not diagnose, treat, or prevent any condition.
Parents and caregivers must consult licensed professionals (e.g., pediatricians, speech-language pathologists) for medical or diagnostic advice.
By using the Services, you acknowledge and agree that Autism Inventory, Inc. is not responsible for medical outcomes, missed diagnoses, treatment decisions, or reliance on Speak & Play in place of professional care.
8B. Limitation of RelianceYou understand that any reliance on Speak & Play reports or outputs is at your own risk. Speak & Play does not guarantee the accuracy, completeness, or clinical applicability of any information provided. The Services are designed to support, not replace, professional judgment.
9. Limitation of Liability
Speak & Play is not liable for indirect, incidental, or consequential damages, including loss of profits, data, or goodwill. Our total liability shall not exceed $1.
In addition, Speak & Play shall not be liable for:
Any claims that its Services constitute diagnosis, therapy, or medical treatment.
Any harm, injury, or delay in professional intervention resulting from reliance on Speak & Play.
Any regulatory or compliance issues arising from user misuse of the Services.
10. Governing Law
These Terms are governed by the laws of California, USA. Disputes will be subject to the exclusive jurisdiction of the courts in Orange County, California.
11. Dispute Resolution
Disputes shall be resolved through binding individual arbitration, not class or representative actions. Arbitration will follow the rules of California and take place in the United States.
12. Relationship, Termination, and Survival
Relationship: These Terms do not create a partnership or agency relationship.
Termination: Speak & Play may suspend or terminate Services at its discretion.
Survival: All sections of these Terms survive termination.
